One stop beats has a short list of some artists whose music is forbidden to sample and clear for publishing, like Prince, Anita Baker, Pink Floyd, etc. Anyone know where I can get a longer list of artists who music is unclearable?

It puzzles me that it says you cannot clear those mentioned artists, because all of them have been sampled in known tracks.

Sorry, I looked around and could find other lists for you.

Thats true, I've also heard a few Prince samples. Maybe if the money and the marketing is right, they'll go for it. Money talks. Good lookin out tryin to find some lists though, I couldn't find any in my searches either.

There's really no such thing as unclearable samples. It all depends on the owner of song. Thats it. And like that nigga said, Money Talks.

Henry Mancini has been sampled loads of times e.g. by Outkast - Skew it on da Bar-B.

Things is, if you have the dough, or even without the dough, some people will use a sample no matter if it get's cleared or not, because it's so good they know they are almost guaranteed a hit single that will make way for their album. Their don't make a dime of the song itself, but the song makes way for the rest of the album.

i think that alot of these that have been sampled may never have been cleared though... primo used an anita baker shit and im sure he aint clear that.... a shitload of cats have used pink floyd... the most recognizable one i cant rememeber their name but it was some real underground shit so they definately never cleared it... the one thing people forget about sampling is they have to prove you made money off it to get at you... thats why lots of white label 12"s come out with tracks that never show up on cats albums... like that good times track by ghostface.... they couldnt clear it but it was already out all over the place on 12"s ... especially if you sellin shit out the trunk with no track keeping of sales, its real hard for them to sue you.... they cant sue you just for sampling, its the money thats made off it....

just to irriterate the above statements....money talks....it doesnt matter who the artsit is, if the price is right, they're gonna clear it...Prince, Paul McCartley etc etc, if the cheque's got enough zero's at the end, anyone will sell their shit....as a matter of fact, 99% of PEOPLE in general would probably sell their soul to the devil for enough money....thats the society we live in nowadays

All i am saying is that if you tryin to get a track on a project and sample one of the above chances are they are not going to clear it, whether a company that owns the rights or worst the artist! I mean if you give then 1 000 000$ of course they will but thats just plain out stupid you know! Thats all i am sayin, so if you placing a track with one of those samples have a plan B cuz there is high chances it wont get cleared!

Peace

Usually, both...

You have to get clearance from those who own the master recording, usually the label, and those who own the publishing, usually the artist, or the producer and team of writers.

I think Stradivarius and djswivel make good points. This is one to grow on for those out there who like sampling 4 seconds of well known and succcessful songs. You must pay to play. I remember Tatianna Ali ( hope I spelled it right) used the same sample that Tommy Gunn used in the uptown anthem Deja Vu, it was reported that she paid well into the hundreds of thousands for just that one sample. The album didn't do to well. That's gotta hurt!

I remember Prince in an interview saying he would of let Puffy use a sample for some Biggie song if Puff owned his masters. But I think he came out with a box set of remade material some years back where it was like really expensive, but you were allowed to sample it or something. I dunno, I'll try to look for interview.
