Hey what up cats, I'm pondering if sampling a record or thirty intergrated into a beat and given away to peeps for free is illegal? Got a silly fresh flavor that needs to be savored, know what aye mean.

If you are completey a conscious law abiding individual of course there is some element that could be construed as illegal, even giving it away possibly since you are in essence using someone elses work to somewhat promote yourself in a way......

on the other hand there is no stopping sampling at this point, I think that everyone that has a means to make a beat samples and that number of people are much greater than back when Biz Markie, De La and the Beastie Boys were being sued....

so you have a trick question...... is it illegal? I would say yes even though I am not a lawyer all it takes to answer a question like this is plain old common sense....should you do it anyway sure go ahead but look at the headlines everynow and then where cats are busted for mixtapes...but of course they sell them but they have known instrumentals with other rappers than the original but nonetheless those instrumentals are copywritten and belong to someone else......

my thoughts.

Bigdmakintrax,

No doubt. It's common sense, even Common had to change his name from the latter to avoid lawsuit actions. Definitely feelin ya on that promo tip, it's a question of haunting. Considering it with your feedback, do I really want to be haunted? Plus sampling just feels mad guilty nowamoments for some reason; maybe its all the hype in the industry and lack of finances to walk the beat/talk?

Flipping the script, Gilberto Gil, famed Brazilian musical maestro is releasing his next album, a hits comp # under the auspicious Creative Commons title which is a lot like copyright, yet this CC license ultimately allows you to sample freely and optimistically. Dozens and more are hopping on board. Pulled up this website while typing this post so you could peep it out. Revolutionary cool...
