Here's some food for thought, I can't wait for the logic to come:

What about jacking software?

Person A using a product that Person B put together, using it for their own personal gain, without Person A giving anything to Person B for their work?

Intellectual rights area a real mother, aren't they?

ok. I forgot to say this the other day... well in college I had to take a music copywrite class, w/ a REAL music lawyer and do you know that your files from the computer can be use in court to prove that you're the orignal owner or maker of the beat... but you have to have intent on sending in the copywrite form...but ever file you make has a date and time stamp as you all may or may not know...and they can compare the time stamp from your beat w/ the other persons and see when was your file created and when was theirs.... if their file was created after yours, you have a good case to go w/, and all you need to do is prove how they came in contact w/ your beat, and their means of jacking it, like the kid did[ie: slowing it down, the posting on their website, the meetings] then you could win.... the posting are proof too, and by law if the courts order it, they have to hand over their server and they'll go through ever file and see what the deal is....but the kid has a case if it's real, he's just too lazy to "GET UP, GET OUT, AND DO SOMETHING"...

And speaking of sampling... what do you think of this..."I got a story to tell" "they said cant use it because of a problem with a sample...All we had to do was take a piece out, whick in the original sample was really just the harp part. I knew if I could get it to the point where it's unrecognizable, we were good.So I went in, grabbed the guitar and started filling in the pieces. I took the same melodies. I just changed a few of the instruments. I moved it from harp to the guitar, put a little bit of harp in there, but anybody that knows that original record is probably scratching their heads, like, "How the hell did he...?"......NOW! IS THAT BITING OR WHAT????????? -XXL April03.... DAMN!

One Love. and I am out.

Only thing the neptunes did wrond in my opinion is not give the dude a lil money. The drum pattern is obvilously the same thing tweaked a little. But thats only 20% of complete music, They had to add melody, the guitar parts and littles elemet that made is a complete song along with the vocals. So its not totally jacking. All of us have either vibe off of drums from somebody esle and made it better or different. I know I have use a preset or two to build a song off of so. OR a sample drum loop. All the top producers use elements from apprentice producers. Dre has a keyboard manl, a drum man , a bass player. What the difference here. How many time have you loved a song then heard the orginal sample and was like damn they didn't do nothing to it. They made it HOTT. Thats what they did. Once yall get big you gonna get submisson of beats and you gone use some of the stand out stuff to help you. Just pay the man

So from what everyone's saying - if for example, Lionel Richie came up to you with a CD that had a new track he did and said, "Hey check this new song I did". And then you take that song and "replay" or "reproduce" it and release your "own" song - that's ok? You take this Lionel Richie song and re-do it but add a bit of guitar over it and change the tempo - that's not stealing????

It is stealing. Sampling is taking somebody elses work, If the neptunes got this kids permission it would still be taking somebody elses work. Why do you think people get sued over samples that are not cleared its not your shit. No matter how different you arrange it, you know its somebody elses. Its easier to just sample somebody else or take or buy somebody elses shit than to create you own.

That the Pros stealing samples there... BadBoy at that....you can't tell me Puff doesnt have the money to clear that sample...Some artists are tight asses w/ their music and they have all the right to be...If you read that issue, you also read that...Chuck D. got butt hurt over how Premo used his voice on "Ten Crack Commandents"....So people just dont get what others are trying to do...and "Ten Crack Commandents" is an hiphop classic, what would it be like w/o Chuck D's voice on the hook, Who knows....

I agree with fade about samples and beat jacking but they are both a bit different in a certain context. Beat jacking especially from the major producers is not exceptable because of all the equipment and budgets they have to create there own music it just makes no since for them to rip someone off. As far as any cats in this forum or not on a major level yet, if we sample a cut, bassline whatever from another artist, we are infringing but 9 times out of 10 we aren't makin nearly enough money off of the sample to warranty them sueing us. And I'm sure most cats in here would agree to pay for the sample before using it if they had the means. When you start getting into the million dollar range and your sampling on the fly then you deserve to pay someone off because they helped you make a hit record! Thats the whole idea isn't it, but us little guys aren't making enough money in the first place for them to even want to notice.
