copyright on scratching

I just wanted to know, from any producers or any of you that sell enough to hafto get permission to use samples, about scratchin. When you scratchin somebodys accapella for a track, do you hafto get permission for that too?

I have the Xecutioners 'Built From Scratch' album. And theyre scratchin all these Accapella's, from old comedy records to wutever. And when you look in the credits, the only 'Contains samples from' thing i saw was a mobb deep record. No other samples credits. I was kind of confused. Anybody know wuts goin on?

If you ever heard: "That Ol' Real Shit" by Rakim, they got a part of one of Prodigy's (of Mobb Deep) lines. He says "That Ol' Real Shit", over and over, during the chorus. But theres no sample credit. I know they couldve got it cleared, but you never know.



Another thing, If you didnt hafto give credit to other people's accapellas, dont you think everybody would be scratchin everybody else all over the place?

I'd like to know the answer to this too, but it's very possible that either:

1. They didn't clear the samples that they scratched.
or
2. They cleared them, but just didn't list them in the credits (maybe because it would take up tons of space in the album notes for so many vocals samples).

Maybe they paid for sample clearance and they didn't need to pay for publishing rights or something like that??

I've wondered the same question with "the next episode". Everyone knows that Dre sampled Dave Mcallum/David Axlerod but there's no mention on the cd sleeve or anywhere

THEN THE PERSON WHO COPYWROTE THE SCRATCH WOULD COLLECT ROYALTIES EVERYTIME SOMEONE USED IT. THATS CRAZY

IT WOULD BE THE END OF THE DMC COMPETITION AND I WOULD BE OUT OF A JOB

ART MPC 4000, it's not the scratch itself people are referring too, but the vocal samples used in the scratches...

Like Dre, Wu-Tang hasn't always listed the samples either. I guess they have just paid more to keep it a secret, or they have a very good sample clearing company.

Obtaining permission to use a "verse" is the requirement, once you've obtained permission to use the "verse", you can LEGALLY scratch it, play it as it is, flip it, reverse it or any other effect that you want to put on it (keyword is LEGALLY). Getting permission to use the "verse" doesn't automatically mean that you have to give credit for it but most labels do (kinda like a mutual respect thing).
