I have created some tracks where i have used samples from older songs. I plan on putting these on cd to give out to my friends etc, but i am wondering is it illegal to sample and not get permission from the artist or record label? Thanks

Exactly, or if you plan on taking the finished work to some large volume and respectable, disc duplication service they won't do it because they would be liable for making unauthorized copies of copywritten work(contains uncleared samples)....it wont matter whether you sell them or give them away in that case....same applies too you if you press up copies yourself even for promo, most people don't realize this part that's the part of the law that would kill any sampling debate as far is what is and isn't legal about it when you don't get permission, it goes beyond just sampling without permission, but making copies of it without permission and putting it on cd and selling or giving it away is what people forget....you can be fined per violation of using and uncleared sample and per copy of it you got pressed up....so it's illegal, but everyone does it anyhow LOL.
