If Kanye didnt clear it then he should pay. But man, I really doubt that is the case. The dude has lawyers up the wazooo, there is no way they would not clear it. My guess is that Kanye's people cleared it the record label and the guy from the original group is feeling shafted. He should be going after his label.

Again just my guess, based on no facts. But seems likely.

I see two 'wrongs' here...The first 'wrong' is ofc sampling somebody elses ish without clearance. The second wrong is for dude to seek half a mil for a song thats been dead forever! So to me, Kanye should have to pay, but a 1/2 mil is ridiculous, even considering the lawsuits of the past where cats got sued and lost ALL rights and revenue for the song they created using a dead sample. I feel there should be a set penalty fee for copyright infringement instead of the idea of suing for an outrageous amount of money and settling for whatever the judge awards them...and the idea of giving ALL rights and revenue to the victum is just retarded.

So yeah, I agree with dp...We're waaaay too far into this 'getting sued for copyrights' bs...there had to be a mistake somewhere and it is probably dude feeling shafted.

I agree with dac this wasnt even a money maker for kanye. this was something kanye released to the public just for the hell of it back in the day. If he was wants to sue someone, sue jayz. This beat was a hidden track on the first blueprint album. thats where the money was made.

Yeah Im sure he wasn't browsing thru youtube and came up on kanye version. Someone told him and because its a big name like kanye he wants to sue. If it were someone from ill im sure he wouldn't have said or done anything.

If the song was on one of Kanye's offical albums im sure he would have cleared the sample.

Damages in sample lawsuits should be relative to the monetary success of the original work not the new one.
Why should I suffer because nobody knew the name of some genius guitarist, who couldn't sell a song?

500Gs is most likely just a "throw it out there figure".. when i was involved in a car accident, 2 of my friends that were in the car sued for 1 million dollars... my lawyer sued for $100,000... when the dust cleared, i got $30,000 and they got $10,000 a piece... i think its just a number.. the judge will make the final judgement, OR... Kanye will settle.

they base it on the artists pocket not the original songs success and to me thats a problem.

i think thats true also... now if Kanye loses in court, it opens up a whole plethora of lawsuits for every uncleared sample throughout his career... should be interesting to watch.
